Agreement and Disclosure Information

 

 

Continental Federal Credit Union (CFCU) requires acknowledgement and acceptance of the terms and conditions described herein to all members and guests visiting our site(s) on the internet.

 

A. Introduction

 

Throughout this Disclosure, the words “we”, “us”, “our”, “Continental FCU”, “credit union” and “CFCU” refer to Continental Federal Credit Union both separately and doing business as US Airways Credit Union. “You”, “yours” and “your” means each and all of those (whether one or more persons) who are subject to the agreement(s) as a result of signing an Account Signature Card for each perspective account.

 

B. Business Day Disclosure

 

With the exception of Continental FCU holiday schedule, the term “business days” means Monday through Friday, excluding Saturday and Sunday.

 

C. Access Requirement

 

Continental FCU e-Branch Home Banking access requires you to have an eligible Continental FCU account (listed below) and an online password. In addition, you must have the required software. (E.g. adobe acrobat, etc.)

·          Checking Accounts            

·          Money Market

·          IRA

·          Vehicle Loans

·          Personal Loans

·          Home Equity Line of Credit (HELOC)

 

 

 

D. Types of Available Transactions

 

You can manage your accounts from your home or office on your personal computer through Home Banking. You can use e-Branch Home Banking to do the following transactions:

 

·          View account balances and review transaction history

·          View images of checks and statements

·          Make transfers between your accounts

·          Make transfers to make loan payments

·          Apply stop-payment on a check drawn from your Continental FCU account

·          Pay Bills to any merchant, institution or individuals within the U.S. (U.S. Address)

·          Apply for consumer Loan

·          Withdraw funds from your checking, savings or loan accounts by check, made payable to you and mailed to you at the address we have on our records at CFCU

 

 

E. Terms and Conditions

 

Continental Federal Credit Union (CFCU) maintains this Site to inform CFCU members and visitors of our products and services. Access to our Site confirms your agreement to be bound by all applicable laws and regulations and CFCU terms and conditions which will be updated from time to time. These products and services require eligibility.  CFCU reserves the right to determine the eligibility of any product or service mentioned herein.

 

The electronic access systems are authorized only for domestic use within the United States and territories that fall under the jurisdiction of U.S. Laws and Treaties. CFCU has no responsibility for any usage going outside or through the territorial jurisdiction of the United States or any violations of foreign encryption or telecommunication prohibitions or laws.

 

F. Additional Disclosure Applicable to Bill Payer

 

If you choose to use CFCU Bill Payer, in addition to the Continental FCU features previously listed, you may also pay bills online from your Checking Account ONLY to persons or entities you select. You understand that payment of taxes or court-directed payments through the Bill Payment services is prohibited.

 

You understand and agree that you must be 18 years of age (or age of majority depending on the state in which you reside) to set-up or use Bill Payment. Bill Payments can be from any amount between $1.00 and $9,999.99. When you schedule a Bill Payment using CFCU Bill Payer, you authorize us to withdraw the necessary funds from your checking account. You agree that you will instruct us to make a withdrawal only when a sufficient balance is or will be available to your designated checking account or funds are available through your checking account overdraft source(s).

 

Your Bill Payer may be canceled at any time without prior notice due to insufficient funds and may be reinstated once funds are available in your accounts to cover any fees and other pending transfers or debits. You may call (800)421-6887 or email callctr@continetalfcu.org to reinstate your Bill Payer.

 

Transferring Funds – The number of transfers from a Savings Account is limited as prescribed in Reg-D. You cannot transfer portions of the funds for deposits that have been placed on hold until that hold expires.

 

Designating a Bill Payer Account: When you set-up your Bill Payer, you must designate a checking account ONLY as your Bill Payer account. In the event you close your Bill Payment checking account, or if it is no longer linked to your Bill Payer, your Bill Payer will end and any unprocessed bill payments will not be made. If you change your checking account type or your account number, you understand that you must re-enroll in Bill Payment and re-establish schedule bill payments from your previous account.

 

Canceling your Bill Payer Services: If you choose to discontinue your Bill Payer, any unprocessed bill payments will be canceled. You understand that you should cancel any scheduled bill payments prior to notifying us in writing that you are discontinuing the Bill Payment services. You may cancel a bill payment transaction up to, but not including, the date you scheduled it for processing. You must call (800)421-6887 cancel before the end of our business day prior to the date the transaction is scheduled to be processed.

 

 

 

G. Additional Disclosures Applicable to Preauthorized Payment Services

 

If you have requested a preauthorized payment from your account (e.g. preauthorized payments of insurance premiums), the following information applies to you:

 

Right to Receive Documentation of Preauthorized Payment:

 

Initial Authorization: You may get a copy of your preauthorized payment documentation from the third party being paid at the time you give them your initial authorization.

 

Account Access: Preauthorized payments may be withdrawn from your designated Bill Payer account.

 

Notice of Varying Amounts: If your preauthorized payment varies in amount, the party who will receive the payment is required to notify you ten (10) days before each payment will be made. You will agree with the person being paid to receive this notice only when the payment differs by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set.

 

Right to Stop Preauthorize Payment: If you want  stop any preauthorized payment or revoke a preauthorized payment authorization, you must call us at (800)421-6887 or email us at callctr@continentalfcu.org  within three (3) business days or more before the payment is scheduled to be made.  If you notify us verbally, we may require you to put your stop payment request in writing within fourteen (14) days after you call. CFCU will not be liable for any losses or damages that may occur if timely notice is not received. Schedule of Fees for Stop Payment Order is applicable.

 

H. Additional Disclosures Applicable to Preauthorized Deposit of NET Pay check, Payroll Deductions, Pension Checks and Federal Recurring Payments

 

If you have arranged for preauthorized electronic deposit on your net paycheck, payroll deductions, pension checks, or federal recurring payments (for example, Social Security payments), the following information applies to you:

 

Account Access: Preauthorized deposits may be made to your share or checking account(s).

 

Notification of Preauthorized Deposits: If you have arranged with a third party (e.g. social security administration) to make preauthorized deposits to your account at least once every sixty (60) days, that third party making preauthorized deposits may have agreed to notify you every time the party sends you money to deposit to your account.

 

Documentation of Preauthorized Deposit: You will receive a monthly account statement for each month in which a preauthorized deposit is made but at least quarterly if no preauthorized deposits are made. However, we reserve the right to send quarterly statement for accounts having preauthorized deposits only on their electronic service.

 

G. Regulation “D” Restrictions:

 

Preauthorized, automatic, or telephone withdrawals or transfers from Share and Money accounts are limited to no more than six (6) transfers in each calendar month. No more than three (3) of the six (6) withdrawals or transfers may be made by check, shared draft, or other order including debit cards. However, you may make an unlimited number of withdrawals from or transfers among your own share accounts by mail, messenger, or in person at the credit union or at an ATM or POS terminal. You may also make an unlimited number of withdrawals from your share and money market accounts by telephone if you request us to send you a check. Transfers or withdrawals in excess of the above limitations may not be honored.

 

H. Disclosure of Account Information

 

This agreement authorizes Continental FCU to disclose information you’ve provided about your account to third parties, agents and affiliates, such as independent auditors, consultants, and attorneys.

 

·          To comply with government agency or court orders or requests

·          To complete transactions as necessary

·          To verify existence and status of your account for third party such as credit bureau

·          To provide services relating to your account or to offer other products and services unless, you’ve opted-out on a specific product

·          As per your request.

 

I. Unauthorized Transaction from your e-branch Home Banking

 

Please notify us immediately:

·          if you believe another person has improperly obtained your password,

·          if someone has transferred or may transfer money from your account without your permission

·          If you suspect any fraudulent activity on your account.

·          If your password has been compromised

 

J. Error Resolution Notice

As soon as you identify any errors or discrepancies in your statement or transaction record, you must notify us immediately within sixty (60) days after we have sent your first paper or electronic statement on which the error occurs.. You may notify us verbally, but we may require you to send us a written dispute within ten (10) business days of which we may correct the error promptly. Should we need more time to investigate the error, we will notify you and credit your account within ten (10) business days for the amount that you think is in error while we investigate your complaint. We may take up-to 45 calendar days to investigate your complaint during which time; the provisional credit will be available.  However, we may not credit your account if written dispute was not received by CFCU within ten (10) business days after we hear from you.

 

For new accounts, we may have twenty (20) days to resolve your claim or to provisionally credit your account. If CFCU needs additional time to investigate your claim, we have up to ninety (90) calendar days to complete our investigation.

 

We may take up to ninety (90)  instead of forty five (45) calendar days for an electronic fund transfer resulting from a Point of Sale debit card transaction, that are initiated outside of the United States.

 

Continental FCU will notify you of the results of the investigation within three (3) business days after completing the investigation. If we decide that there was no error, we will send you a written explanation and request for you to make funds available for us to withdraw the provisional credit provided.

 

 

K. Changes to Charges, Fees and Other Terms

 

Although, there are no fees for accessing your account online, we reserve the right to change the charges, fees or other terms described in this agreement. We will notify and update you of any fee changes and charges. As always, you may choose to accept or decline changes by continuing or discontinuing the accounts or services to which these changes relate.  It is the discretion of CFCU to waive, reduce or reverse charges as it deemed necessary.

 

Please note that fees may be assessed and billed separately by your online service provider.
